Welcome to Pylari.

These Terms of Service (“Terms”) govern your access to and use of pylari.com and any other website, page, service, or sales channel operated by Pylari that links to these Terms collectively, the “Site.”

These Terms also apply to purchases made through the Site.

By visiting the Site, creating an account, submitting information, or purchasing a product, you agree to these Terms and our:

• Shipping Policy

• Refund Policy

• Any other policies or notices posted on the Site

Please read these Terms carefully before using the Site.

1. Eligibility

You must be at least the age of majority in the jurisdiction where you live to use the Site or place an order.

The items included with a product are those specifically listed on the applicable product page or order confirmation.

We may correct errors, update information, or cancel an affected order when necessary. If we cancel an order after payment has been collected, we will refund the affected amount to the original payment method.

4. Product Availability

Products may be available in limited quantities.

We may:

• Limit quantities purchased by one person, household, account, payment method, or address.

• Discontinue a product or variation at any time.

• Limit sales to particular countries, regions, or jurisdictions.

• Refuse orders that appear to be placed by unauthorized resellers or distributors.

Displaying a product on the Site does not guarantee that it will remain available.

5. Prices, Taxes, and Charges

Unless otherwise stated, prices displayed on the Site are in U.S. dollars.

Promotional codes:

• Must be used before their stated expiration date.

• Cannot be redeemed for cash.

• May be limited to one use per order or customer.

• May not be combined unless expressly stated.

• May be canceled if used fraudulently or contrary to their terms.

6. Orders and Acceptance

When you place an order, you are offering to purchase the selected products under these Terms.

After placing an order, you may receive an automated confirmation email. This email confirms that we received your order. It does not necessarily mean that we have accepted it.

We may review, accept, refuse, or cancel an order for reasons including:

• Product unavailability

• Incorrect product or pricing information

• Suspected fraud or unauthorized activity

• Payment authorization problems

• Shipping restrictions

• Orders placed for unauthorized resale

• Errors in customer or delivery information

Unless applicable law requires otherwise, an order is accepted when we send a shipping confirmation or otherwise confirm that the order has been fulfilled.

If we cancel an order after charging you, we will issue a refund to the original payment method for the canceled amount.

By submitting payment information, you represent that:

• You authorize the applicable payment provider to charge the displayed order total.

We do not directly store complete payment-card details.

Delivery dates are estimates unless we expressly guarantee a specific date.

Delivery may be affected by circumstances outside our reasonable control, including:

• Severe weather

• Customs inspections

• Transportation interruptions

• Incorrect delivery information

• High-volume periods

• Local delivery restrictions

If we cannot ship an order within the timeframe we stated, we may contact you with a revised estimate and the options available to you, including the right to cancel and receive a refund where required by applicable law.

10. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, order cancellations, and any applicable trial period are governed by our Refund Policy.

The Refund Policy explains:

• Responsibility for return-shipping costs

• How damaged, defective, incorrect, or missing items are handled

Nothing in these Terms limits any consumer right that cannot legally be waived.

11. Product Use and Safety

You are responsible for reviewing and following the instructions provided with our products.

Before each use, inspect the product and its components for damage, wear, loose connections, leaks, or other defects.

Do not use a product if it appears damaged, defective, or unsafe.

The Hydra Pro™ Vest and its hydration components are intended to help carry water and personal essentials. They are not:

• Protective or emergency-safety equipment

• A guarantee against dehydration, heat illness, injury, or exhaustion

• A substitute for appropriate route planning, weather preparation, hydration planning, or professional advice

Water needs vary based on the individual, activity, temperature, humidity, distance, and other conditions. You are responsible for determining whether you are adequately prepared for your intended activity.

Use the product only for its intended purpose and in accordance with the instructions provided.

12. Product Warranty

Certain products may be covered by an express warranty described on the applicable product page or in a separate warranty policy.

Any express warranty applies only:

• For the period stated

• To the products or components identified

• To manufacturing defects covered by that warranty

• To the original purchaser, unless otherwise stated

• When the product has been used and maintained as instructed

A warranty may not cover:

• Normal wear and tear

• Cosmetic damage

• Accidental damage

• Misuse or improper care

• Unauthorized alterations or repairs

• Damage caused by incorrect cleaning or storage

• Loss or theft

• Products purchased from an unauthorized seller

• Damage caused by exceeding the product’s intended use

Where an express warranty applies, its specific terms will control.

Nothing in this section excludes warranties or remedies that cannot legally be excluded.

13. Unauthorized Sellers and Resale

Pylari does not authorize the resale of its branded products unless written approval has been provided.

We cannot verify the authenticity, handling, condition, storage history, or eligibility of products purchased from unauthorized third-party sellers.

To the extent permitted by law, products purchased through an unauthorized seller may not qualify for:

• Pylari customer support

• Promotional guarantees

• Returns or refunds through Pylari

• Product-replacement programs

• Voluntary manufacturer warranties

This does not affect any legal rights you may have against the third-party seller from whom you purchased the product.

You may not commercially resell, distribute, or export our products without our prior written authorization.

14. Reviews, Feedback, and User Content

You may be able to submit reviews, photographs, videos, comments, feedback, or other content through the Site or our communication channels.

You retain ownership of content you create. However, by submitting it to us, you grant Pylari a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, publish, display, edit, adapt, translate, distribute, and promote that content in connection with our business and marketing.

You represent that:

• You own or have permission to submit the content.

• The content reflects your honest experience or opinion.

• The content does not violate another person’s rights.

• The content is not false, misleading, unlawful, threatening, or defamatory.

• The content does not contain malicious software or unauthorized advertising.

We may remove or decline to publish content that violates these Terms, but we are not required to monitor all submitted content.

We will not condition a reward or incentive on the submission of a positive review.

15. Intellectual Property

The Site and its contents are owned by or licensed to Pylari and are protected by applicable intellectual-property laws.

Protected content may include:

• Business and product names

• Trademarks and logos

• Product descriptions and written copy

• Photographs and graphics

• Videos and audio

• Website design and layout

• Product packaging and brand materials

• Software and code

You may access and use the Site for personal, non-commercial purposes.

Without our prior written permission, you may not:

• Use our trademarks or branding

19. Disclaimer of Warranties

Except for any express warranty stated in writing and except where applicable law provides otherwise, the Site and its contents are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we do not guarantee that:

• The Site will always be available, uninterrupted, or error-free.

• All Site information will always be complete or current.

• Every product will meet every customer’s personal preferences.

• The results or experience of one customer will be the same for another customer.

To the maximum extent permitted by law, we disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

This disclaimer does not limit an express product warranty or any warranty that cannot legally be excluded.

20. Limitation of Liability

To the maximum extent permitted by law, Pylari and its owners, officers, employees, contractors, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

• Your access to or use of the Site

• Your inability to access or use the Site

• Your purchase or use of a product

• Third-party conduct or services

• Unauthorized access to or alteration of your information

This may include loss of profits, revenue, savings, data, goodwill, or business opportunities.

To the maximum extent permitted by law, our total liability arising from a product, order, or these Terms will not exceed the amount you paid to Pylari for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the limitations above apply only to the fullest extent permitted by law.

21. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Pylari and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:

• Your material breach of these Terms

• Your unlawful use of the Site

• Your infringement of another person’s rights

• Content you submit to the Site

• Your unauthorized resale or commercial use of our products

This section does not require you to indemnify Pylari for conduct for which indemnification cannot lawfully be required.

22. Governing Law and Disputes

These Terms and any dispute arising from them will be governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.

Unless applicable law requires otherwise, any legal proceeding relating to these Terms, the Site, or a purchase from Pylari must be brought in the state or federal courts located in Lewes, Delaware.

You and Pylari consent to the personal jurisdiction of those courts.

Nothing in this section prevents either party from:

• Bringing an eligible claim in small-claims court

• Seeking emergency or injunctive relief

• Exercising consumer rights that cannot legally be waived

• Bringing a claim in another location when applicable law requires that location

Before beginning formal legal proceedings, we encourage you to contact us so that we can attempt to resolve the issue.

23. International Customers

The Site may be accessible from locations outside the United States.

You are responsible for complying with the laws that apply where you live or use the Site.

Where mandatory consumer-protection laws apply, nothing in these Terms is intended to remove rights that cannot legally be waived by contract.

24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent permitted by law.

The remaining provisions will continue in effect.

25. No Waiver

If we do not enforce a provision of these Terms immediately, that does not mean we waive our right to enforce it later.

A waiver is effective only when made in writing by an authorized representative of Pylari.

26. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations as part of a merger, acquisition, corporate reorganization, sale of assets, or similar business transaction.

27. Entire Agreement

These Terms, together with the policies incorporated into them, constitute the entire agreement between you and Pylari regarding your use of the Site and purchases made through it.

They replace prior communications or agreements concerning the same subject matter.
